ARTICLE 1: SCOPE OF APPLICATION
These general conditions of sale govern the sale of the products presented on the site. www.nomad-jewellery.fr (hereinafter the "Site"). Any order implies full acceptance of these general conditions of sale which are intended to define the rights and obligations of the parties within the framework of the online sale of goods and services offered by Nomad. The products offered by Nomad are reserved for adults or minors holding parental authorization allowing them to place an order on the Site.
ARTICLE 2: OFFER
Our offers of products, services and delivery methods are indicated in Euros and are valid while stocks last.
ARTICLE 3: PRICE
3.1 - All the prices of our products are indicated in Euros and take into account the French VAT in force. Any change in the VAT rate could be immediately reflected in the prices. These prices are exclusive of shipping costs.
3.2 - In the event of an order to a country other than mainland France, you are the importer of the product (s) concerned. For all products shipped outside the European Union and DOM-TOM, the price will be calculated excluding tax automatically on the invoice. Customs duties or other local taxes or import duties or State taxes may be payable. These duties and taxes are not the responsibility of Nomad. They are your responsibility and are your full responsibility for both declarations and payments to the competent authorities and bodies in your country. We recommend that you inquire about these aspects with the local authorities in your country.
3.3 - Nomad reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of the order entry, as indicated on the Site.
3.4 - The products remain the property of Nomad until full receipt of the price by Nomad.
3.5 - The products and services sold on the Site are reserved for individuals.
Payment for online purchases is made by credit card via the secure payment platform PayPal. Nomad reserves the right to suspend any order management and any delivery in the event of refusal of authorization of payment by credit card or in the event of non-payment. Nomad also reserves the right to refuse to honor an order from a customer who has not paid in full for a previous order. Unless proven otherwise, the data recorded by Nomad constitute proof of all transactions between Nomad and the customer.
5.1 - General
The times indicated on the Site are the usual average times and correspond to the processing and shipping times. The products are delivered by La Poste or other carrier to the delivery address indicated by the customer when ordering. When the customer orders several products at the same time and they have different dispatch times, the order dispatch time is based on the longest time. Nomad however reserves the right to split shipments. Participation in processing and shipping costs will only be invoiced for one shipment. Nomad cannot be held responsible for the consequences due to a delay in delivery. Any order not shipped within 30 days of the order will be canceled unless otherwise specified and announced in the sales offer.
5.2 - Deadlines
Product delivery times vary depending on product availability. The delivery of the products varies between 5 days and 3 weeks. Nomad undertakes to inform the customer as soon as possible if the deadline is not met. Exceeding these deadlines cannot give rise to any cancellation of the order, reduction of the price paid by the customer, or payment for damages, as long as the customer is delivered within 30 working days following confirmation of his ordered. In the event of the unavailability of the good within 30 days, after informing the customer, Nomad will reimburse the customer.
The customer has a period of seven clear days to exercise his right of withdrawal without having to justify reasons or pay penalties with the exception of return costs, as soon as the product is returned to Nomad in its original condition. Withdrawal period
In accordance with the provisions of article L221-18 of the Consumer Code, the Customer has a period of fourteen (14) days from receipt of his order to exercise his right of withdrawal and make a request for return or exchange, without having to justify reasons or pay a penalty.
Condition of products
Returned items must be:

Any return not respecting these conditions may be refused by Maison Di Giorgio.
Return procedure
To exercise his right of withdrawal and make a return, the Customer must follow the following procedure:

Logging into the customer account
The Customer logs into their personal space via the access icon provided for this purpose, enters their email address, and enters the six-digit verification code received by email. -
Return Request
In the "My Account" area, the Customer selects the order in question, indicates the items to be returned, specifies the reason for the return and can add an additional note. The request is then subject to validation. -
Analysis and validation
After receipt and analysis of the request, Maison Di Giorgio informs the Customer by e-mail of the acceptance or refusal of the return. -
Return Shipping
If approved, the Customer will receive the necessary instructions and a prepaid return label. The package must be dropped off at a post office as soon as possible.
Exchanges
• Size Exchange
Size exchanges are free.
Once we receive your return, we will ship you the new size within 24 hours.
• Exchange for another item
You can exchange an item for another style or color by issuing a voucher for the original amount.
This voucher is valid for 6 months and can be used throughout the site.
Refund
You can request a refund for any reason within 14 days of receiving your order.
A flat-rate deduction of €10 will be automatically deducted from your refund, corresponding to logistics and processing costs.
After receiving your return, you will be refunded within 7 to 15 days, depending on your payment method.
In the event of a dispute, an amicable solution will be sought before any legal action, it being recalled that this search for an amicable solution does not preclude the legal guarantees of conformity of the property with the contract and of hidden defects from which the customer benefits. If the parties do not agree, any legal action will be brought before the Paris Commercial Court.
ARTICLE 9: DURATION
The offers are valid while stocks of products are exhausted and without prior warning of the end of an offer.
ARTICLE 10: ACCEPTANCE AND CANCELLATION
Any order is deemed firm and can only be canceled with the express consent of Nomad and under conditions which will indemnify it for any prejudice or damage caused by this cancellation.
ARTICLE 11: INTELLECTUAL PROPERTY
All jewelry presented on the site or visual or sound elements of the Site are protected by copyright, designs or trademarks. They are the exclusive property of Nomad. Any deterioration, as well as, in the absence of authorization, any representation, reproduction, modification, commercial use, total or partial, of the various elements of the Site is prohibited and exposes its author (s) to prosecution. Any user who wishes to create an electronic link to the Site must first request authorization from Nomad.
ARTICLE 12: RESPONSIBILITY FOR DATA
Nomad makes every effort to ensure the confidentiality and security of data that may be entered or transmitted on the Site. Nomad does not keep data relating to our customers' bank cards following payment. In accordance with the “Informatique et Libertés” law of January 6, 1978, you have the right to access and rectify data concerning you. All you need to do is send us by mail the opposition to access your personal data, proving your identity.
ARTICLE 13: FORCE MAJEURE
Neither party will have failed in its contractual obligations, insofar as their execution will be delayed, hindered or prevented by a fortuitous event or force majeure. ARTICLE 14: CONDITIONS OF GUARANTEE AND AFTER-SALES SERVICE
Any manufacture, regardless of the care, attention given or the quality of the materials used, involves, despite rigorous control, risks of manufacturing imperfection which require appropriate treatment.Nomad has published for this purpose and to meet the needs of its customers the following charter, allowing everyone to appreciate the scope and limits of the guarantees provided.
A) GUARANTEES:
Jewelry Nomad benefit from a double guarantee.
a) Guarantee against hidden defects
This guarantee is exercised under the conditions expressly defined by law and within the set appeal period.
In the event of a hidden defect which would affect a jewel of the Brand Nomad, the Company undertakes to replace the item within 4 weeks of return by the individual, subject, however, that it is a piece of jewelry still appearing in the Brand's catalog.
Otherwise, a replacement item equivalent in value will be offered.
b) contractual guarantees.
Jewelry Nomad are also guaranteed by the company under the conditions specified below, for a period of six months from the day of the sale, transaction made on the site.
The warranty covers any modifications, alterations or degradations of the jewelry inherent in the manufacture or the nature of the material used.
Excluded from the guarantee:
- Degraded items, damaged by abusive use or by a use not in accordance with the nature, the coating, the material used by the manufacturer. Contact with detergents, sea water or swimming pool water, lacquer, perfumes of acid products or any other liquid likely to alter the coatings, materials or simply modify their appearance are prohibited.
- The Company reserves the right to assess, on a discretionary basis, whether the contractual guarantee conditions are met, upon receipt of the defective item.
1) Exercise of the guarantee:
Before and before any sending, the individual must:
- provide the justification for the purchase, with the date and reference. (invoice or copy of the transaction made on the site .....)
- send the article in an envelope specially adapted to avoid any damage, to the head office of the Company.
2) intervention methods within the framework of the above guarantees:
- hidden defect: The Company will replace the defective item outright within a period of fifteen days, subject to availability in stock.
Otherwise, a delay of three to four weeks will be necessary
- contractual guarantee: when the Company, on receipt of the jewel and the proof of purchase, dated and referenced, considers that the guarantee applies, it will proceed as follows:
Repair of the item, if technically possible within 3/4 weeks
Identical replacement, subject to availability in stock, within 3/4 weeks.
Items shipped by the individual are at the expense of the latter who also assumes the risk of loss or damage.
The reshipment of jewelry for which the Company has accepted the involvement of one of the two guarantees above, will be provided by the supplier and at its expense.
B) AFTER SALES SERVICE
The Company provides after-sales service under the restrictive conditions specified below.
This intervention is part of a sustained and lasting commercial relationship between the customer and the supplier intended, in mutual interest, to facilitate the maintenance of commercial links.
Repairs are invoiced according to the extent of the damage suffered by the jewel.
A minimum flat rate of 25 € will be applied, including the return postage costs. The sending of the article for repair supposes the acceptance, without other formality, and the commitment of payment of the aforementioned fixed price.
If the cost exceeds the fixed price, the Company will make known, by Mail, the amount to be paid and after confirmed agreement, the jewel will be repaired.
This will be done within 3/4 weeks.
When the jewel is technically or economically irreparable, it will be scrapped or returned to the professional against payment of postage.
APPENDIX: APPLICABLE TEXTS
Article L. 211-4 of the Consumer Code
The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. It also responds to any lack of conformity resulting from the packaging, assembly instructions or installation when this has been charged to it by the contract or has been carried out under its responsibility.
Article L. 211-5 of the Consumer Code
To be in conformity with the contract, the good must: 1 ° - Be suitable for the use usually expected of a similar good and, where applicable: - correspond to the description given by the seller and possess the qualities that he has presented to the buyer as a sample or model; - present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling; 2 ° - Or have the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
